Additional Terms and Conditions of advertising: Pay per Booking Service

These terms apply to advertisers using our pay per booking service

GoHolidays Ltd is referred to as the Publisher in these terms and conditions for the users of the Pay Per Booking service. The Advertiser refers to the person or entity who owns or operates the property, or their authorised agent who utilises the advertising provided by GoHolidays Ltd websites. The Customer refers to any person who submits a booking enquiry to a Pay Per Booking advertiser. Pay Per Booking advertisers are additionally subject to the Terms and Conditions of Advertising.

1 – Basis of service

(a) No annual subscription fee is charged for Pay Per Booking advertising. Payment for the service is at a percentage of confirmed bookings. For Instant Booking reservations, the charge is created when the guest accepts the booking. For reservations made using the Provisional Booking Process, the charge is created when the owner confirms their acceptance of a booking following the Customer's confirmation of the owner's price offer.

(b) Invoicing is monthly.

(c) The Advertiser agrees to check for Booking Requests regularly, and always respond to them in a timely and courteous manner.

(d) Bookings resulting from sales generated via the Pay Per Booking Service must be managed in the Advertiser's own booking management system, and the Advertiser agrees to take responsibility for collection of payment from the customer.

(e) Once added to the website, publication of advertisements on the Pay Per Booking service is continuous. Withdrawal from Pay Per Booking is effected if the Advertiser requests this in writing.

(f) Advertisers using the Pay Per Booking service can at any time convert their advertisement to a paid annual subscription, and from that point on will receive enquiries direct and with no commission payable.

(g) The Publisher reserves the right to alter the way the Pay Per Booking service functions, or withdraw it entirely, and in either case no compensation will be offered to any affected Advertisers.

2 – Establishing confirmation of booking

(a) The Advertiser can choose from one of two different acceptance processes following receipt of a booking request, which are as follows:

(b) Provisional Booking Process - on receipt of enquiry, the owner does not select 'Instant Booking' option. The guest receives their quote. The guest can then accept the quote, but it is made clear to them that the booking is provisional, and will only become a confirmed booking when the owner has confirmed this separately.

(c) Instant Booking Process - on receipt of enquiry, the owner selects the 'Instant Booking' option, and also an expiry time after which the offer will no longer be honoured as an Instant Booking. The guest receives their quote. The guest can then accept the quote, and provided they do so before the expiry time specified by the owner, it will become a confirmed booking at this point.

(d) The Advertiser agrees to make payment as due for bookings generated via the Publisher's services, and undertakes not to attempt to contact the Customer with the intention of depriving the Publisher of their due fee, and not to falsely state that a booking has not resulted in any case where in fact it has.

3 – Bookings Not Confirmed and cancellations

(a) Charges created upon Booking Confirmation will be invoiced for provided the booking has been confirmed between the Advertiser and the Customer.

(b) It is the responsibility of the Advertiser to request cancellation by the Publisher of any charges relating to bookings which have not been confirmed between the Advertiser and the Customer.

(c) If the Advertiser cancels a bookings which has previously been confirmed between the Advertiser and the Customer, the publisher will not provide a refund of the charge made for the booking.

(d) If the Advertiser cancels a booking because the Customer has not made payment, the publisher will reverse any charge made for the affected booking.

(e) The Publisher reserves the right to contact the Customer about any aspect of their booking.

4 – Notes about these terms and conditions

(a) These terms and conditions take precedence over any other terms and conditions. The Publisher reserves the right to amend these terms and conditions at any time without notice.

(b) Should any clause of these terms and conditions be ruled unlawful, the clause in question will be withdrawn and all other clauses of the terms and conditions shall remain in place and in force.

(c) Continued use of the service provided by GoHolidays Ltd signifies acceptance by the relevant Advertiser of any changes made to these terms and conditions.
